Senior Counsel – Procurement & Construction

We are seeking an experienced renewable energy procurement and construction attorney to be part of our team. The Senior Counsel will primarily support battery and solar equipment procurement, long-term service agreements (LTSAs), and the execution of utility-scale standalone energy storage and solar-plus-storage projects during a period of rapid company growth. The ideal candidate will have significant experience in supporting the procurement and construction of renewable and/or energy storage projects.

Responsibilities:

  • Perform and oversee complex legal services for the equipment supply, construction and operation of utility-scale energy storage and hybrid renewable projects;
  • Serve as legal lead on procurement, construction and operations matters and directly assist other departments as needed;
  • Work closely with internal commercial and technical stakeholders in crafting equipment supply, EPC and related services contracting structures and terms tailored for project opportunities;
  • Interface and negotiate directly with suppliers, EPCs, operators, and other counterparties as needed;
  • Enhance internal transaction processes and contract templates for efficiency and compliance;
  • Facilitate legal support for cross-functional teams;
  • Oversee and manage external counsel in a wide range of matters;
  • Identify and succinctly communicate material risks and proposed solutions to Aypa’s General Counsel and other executives and team leads;
  • Other duties as assigned.

Key Qualifications

  • JD from an accredited law school
  • Active bar licensure in at least one US jurisdiction
  • 5+ years of post-qualification experience, with demonstrated experience in procurement and construction in the renewable energy or energy storage industry
  • Combination of law firm and independent power producer (IPP) experience preferred
  • Expertise in EPC and supply matters, including engineering, procurement and construction agreements, O&M and long-term service agreements, equipment procurement, supply agreements and purchase orders, and safe harboring
  • Expertise in project construction and operation matters, including health & safety, quality control, change orders and force majeure claims
  • Additional experience supporting FERC, NERC and other regulatory compliance preferred
  • Strong computer skills, including Word, Excel, and PowerPoint proficiency
  • Excellent organizational and planning skills with meticulous attention to detail
  • Exceptional written and verbal communication skills
  • Strong interpersonal and diplomatic skills
  • Highest standards of ethics and integrity

Compensation and Location:

Salary: A base salary commensurate with experience.

Bonus: An annual bonus will be awarded based on both individual performance as well as the overall success of the business.
